This is me currently over 2 days now, via my google login I still get the Game Data error. I have 6 accounts, both Google and PTC. I can login to 5/6 which tells me all the login/game servers are working just fine and that the issue is with the account. I think it is safe to say that any account with this error is or has been removed from their data and or locked. It would be lovely if it was just a temp ban, but so far I am lead to believe it's time to cut our losses and realise we took the risk and we payed the price.

So what I'm taking from this is, yes we are banned, and the message "Failed to get game data from the server" is just a place holder until the next update.

Small update: Like the rest of you poor souls.. my main account still receives the data error.

The new account I started around 9pm yesterday botted all through the night and day up until I got home (5:45pm) and is now level 22! No bans whatsoever..
And to think.. I only botted MAYBE an hour a day for dust/candy on my main..

I'm starting to think they just flag users and will be just banning people in waves. If not, then this new account will be legit upon reaching my previous accounts level. (26)

Just my 2 cents to add,

3 of my accounts had been in softbanned in last 18 hours ago since the new pokestop cant spin more than once anymore to uplift the softban.

2 of them are Google accounts and still in softbanned.(pokemon always flee but still can loot pokestop item n exp but cant spin abuse anymore, i believe Niantic already lock that shit hole for all cheater lol). I did get the "Our server are humbled by your incredible botting " message when I try to log in 2 of the Google accounts with legit Pokemon Go app from store.

1 account is ptc and already back to normal playing in like 2 hours.

IMHO here, aggressive botting will sure getting hammer down as soon as Niantic detect them on the spot like 2 of my Google accounts which were sucking all exp and stardust and pokestop in light speed for long period of unrealistic time.
- cause hours long or prolly days of softbanned if not perma banned idgas if that happen tho lmao.

The ptc account I set only for farming Magikarp candy at the water area and walk like 4~5 km/h in 400 m radius.
- cause half an hour to couple hours of softbanned if caught by server police.

Not really sure about the banning procedure anymore. I had my main account that went from can't loot pokestops to can't log in error.

I then tried botting my lvl 7 account on PTC on which I didn't bot before. Went alright for 8 hours while walking speed was set to 15km/h. I then wanted to test the limits, set it to 60 and got soft banned in like an hour (catch flee). In another hour or so I couldn't loot any more pokestops and after that, I can't even log in to the account anymore.

So I don't actually think there are any ban waves right now and I'd like to think that they just ban super high xp/h accounts or super fast moving accounts, but there are still some accounts botting at 100k xp/h and going strong for several hours.

This thing is such a mess tbh.

I have no idea what's going on. But just to put out there what I use and how I got banned. I live about 45 miles from Orlando so I always botted in the Magic Kingdom. I never jumped to there, always walked my bot there first, down the highway, with a joystick app. I always botted at 28kph and never once used anything else, no sniper or anything. So take that for what it's worth. I got banned and I theoretically made it look I was 100% playing as I was trying not to get banned, lol. I even logged in after I leveled to collect rewards. So yea, all of the theories of this and that are all just that, theories. Why not just wait for them to put an official statement out there. Or at least wait until someone get an actual email themselves. *Oh yea, I used spegeli's*
