I then wanted to test the limits, set it to 60 and got soft banned in like an hour (catch flee). In another hour or so I couldn't loot any more pokestops and after that, I can't even log in to the account anymore.
So I don't actually think there are any ban waves right now and I'd like to think that they just ban super high xp/h accounts or super fast moving accounts, but there are still some accounts botting at 100k xp/h and going strong for several hours.
This thing is such a mess tbh.
Sorry to break it to you but I got banned and my account was doing 9k/h around level 28 and was moving at 3m/s

So take that for what it's worth. I got banned and I theoretically made it look I was 100% playing as I was trying not to get banned, lol. I even logged in after I leveled to collect rewards. So yea, all of the theories of this and that are all just that, theories. Why not just wait for them to put an official statement out there. Or at least wait until someone get an actual email themselves. *Oh yea, I used spegeli's*
I think they might have a way to detect bots but are unable to create an algorithm that automatically bans bots, I think this ban wave was proactive on their part. Why? I have been botting since yesterday and today on the account that I got back from the error, I am pushing it again I farm 3\4 pokestops within 10 secs catch pokes by the dozens and no ban of any kind.
the only thing that I still refrain from doing is sniping, I am inclined to think this might be related to my other accounts being "banned"

So what I'm taking from this is, yes we are banned, and the message "Failed to get game data from the server" is just a place holder until the next update.
So do you want to just troll and give false information? if you keep reading it says UPON TERMINATION A NOTICE WILL BE SENT. Jesus Christ people. NOTHING IS CERTAIN UNTIL YOU GET A FREAKING EMAIL. IF YO HAVE NOT RECEIVED AN EMAIL, YOUR ACCOUNT HAS NOT BEEN TERMINATED (PERMA BANNED).
Edit: Can it be a ban? Yes. can it be nothing? yes. Until you receive documentation from Niantic themselves, not pokemon.com, not the PTC. NIANTIC themselves, nothing at this time is certain. Keep waiting. It is not surprising their communication is shit, just wait until you recieve proper documentation telling you something.

That is the automated message.. but the automated message does not state you are banned, like this email does.

Would be great if people made some new accounts and tried to do some sniping to gather more data when it gets you banned.

I am not willing to try sniping yet, I am running 2 bots at the same time for the last hour and no ban, it seems more than 2 will get you softbanned with the no pokestops message

Yes I read the whole thing and you just made me read it again to be sure, read the entire paragraph and what you just said isn't stated there.

Make a dummy account, appeal with said dummy account information, you get the same message.

I appealed with a "banned" bot account and it never stated I was banned. Quit being an ******* and actually listen for once in your useless life.

Do you understand what an Arbitration Notice is? If they close your account they will send you a notice to give you the right to dispute said issue. In the United States, any time an account that can hold monetary value (in this case paid items in the form of pokecoins to buy said items) must be accompanied by a notice of some kind with the account closure.
Let's say you spent $100 and they close your account soon after. You're just going to close a customers account right after they spent money on it with out notifying them? Great way to get sued. That's called Fraud. Illegal in the unites states. How to negate this? tell them exactly what caused the account closure to not get sued.
Logic people.

I am so deeply sorry, I did not know what Arbitration Notice was, my native languange isn't english as you probably can tell.
And now all of this make sense, it says "Failed to get game data from the server" because if it said we where banned then they would have had to send an email or else they could get sued, not saying this is the case just saying it's a probability.

Trainer,
We have received your appeal. Our goal is to provide a fair, fun and legitimate game experience for everyone. Use of any other third-party software or app, including but not limited to scripts/apps, applications used to falsify your location, using emulators, modified or unofficial software and/or accessing Pokémon GO clients or backends in an unauthorized manner is considered cheating.

This is the email I recieved when appealing. Does not state anywhere that I was banned.
