Correct we dont have DMCA so on what grounds for a Bot to be dragged before a juge?
Damages? not really and even if, it will be only a few 1000 $ to 100000 $ not 6,5 Millions $ that would be a first.

If you follow any of the EU based legal system Blizzard would have filed in the UK (as they have a branch in the uk) it would have gone to court and MDY would have been nailed to the floor.

I personally think that by keeping it US side it gave MDY a CHANCE (nothing more) to win.

All I can say is that I wish Hamut and MDY the best of luck and I'm happy to hear someone is finally standing up for what is right. People need to look at this as an example, fight back, stand up for whats fair and don't bend over and take it from anybody. Besides, this is a discussion thread, not a "Let's call them stupid for fighting a big corp lollollololol" thread.

I've personally used Glider Elite for awhile, and I hope you guys make a return, cause Glider is the ONLY product that has never let me down.

I think MMO-Glider is just being rediculous, they will never win against a big company like blizzard, i sure hope they win because i used it too and loved it.

But they are just wasting everyones time and alot of money, they just want to be the ones that go against blizzard, i just think this whole lawsuit is pointless.

ThugNL, I agree that it takes a lot of time and money to fight, but that is all I agree with you on.

My brother/family spent around a million to defend a video game IP from Activision (Activision is owned by the same guys that own Blizzard) and they won, so it can and does happen (Go Hamut/MDY!!!)

As for the why, Blizzard is trying to attach EULA/TOS violations to COPYRIGHT infringement. They didn't take Capone down on murder charges, they did it with his taxes. If I bot and get caught, great, they cancel my account and I deserve it, but if I bot and I get charged with COPYRIGHT infringement (very very very serious set of penalties). That essentially allows a private company to arbitrarily codify what offenses would be considered copyright violations. I don't think so, not in the US.

Say Microsoft had something like "if you don't have our seal of approval on your software, then you can't use it in windows". And your company didn't want to have to give up their "code" to MS to approve (every video game for the xbox is compiled by MS and they give the company back a CD to mass produce from).

Now if your code had a better way of doing something, what is to stop the MS folks from just taking a quick peek to see how you do it better...

Maybe you never noticed, but when an updated version of windows rolls out, your current version of office works, but Open Office and Word Perfect need to be updated?

Systems and Applications are supposed to be separate, but when I worked there, we shared the same lunch room... Guess who got the good info first?

Just a small example of where this could go.

There is a HUGE good reason for MDY to fight and WIN. If Blizzard wins and that connection is made, it will drastically change the software industry.

Things may get much worse soon, with the courts trying to find a way to make EULA/TOS violations "hacking" -- and hacking is a *criminal* offense, that can lead to jail time.

Which means that if this theory holds up in court (follow the "Facebook bullying" case, can't remember exact name, for details), we could all actually be found to be criminals just for hacking the game. Not just people who broke Blizzard's rules and might get banned, but criminals who could go to jail.

Yikes, talk about swatting a mosquito with a sledge hammer...

understanble why blizz is upset. we are technicly breaking the law. complicated for all party's involved. been playing retail since day 1, i only play around on a private server to try out specs, classes, armor combos etc..., i myself pm so GM's for cheaters. if you want to cheat, why play retail ?

Towards the end Glider was extremely lovely to use, and has saved me so much time. Let's hope that it all goes well for them in the end.
