Hey guys I just thought I'd share this auto response I got from niantic.
##- Please type your reply above this line -##
Trainer,
Thanks for contacting us regarding your sign in issue with Pokémon GO. If you’ve signed into Pokémon GO and it appears that gameplay progress has been reset, be assured that your gameplay progress has NOT been lost. It remains safe and intact. You may have inadvertently created a new Pokémon GO account by unintentionally signing in with a different email address or login method.
If you haven’t already, please try the following:
* iOS users: Please review the login tips outlined in the Pokémon GO Help Center (Account issues and help logging in – Pokemon GO).
* Google Account users: If you’ve signed into Pokémon GO using your Google Account and it appears that you’re level 1, you may not be signing into Pokémon GO using the correct Google Account. Please try signing into any alternate accounts you may have used to create your Pokémon GO account.
* All Trainers: Keep in mind, there are two login methods for Pokémon GO. Trainers can use their Google Account or their Pokémon Trainer Club account to create a Pokémon GO account. If you create an account with one login method and later attempt to use the other login method, a second account is created. To resolve this issue, log out of your account then log back in using your original login method.
Please note: for security reasons, we’re unable to provide you with the email address you use to sign into your account.

I GPS spoof with NOX on my main, not banned either.
Are you playing with NOX close to your IP?

You might actually have a good point there...

Failed to get server data is definetely a perma ban.
Why?
Simple.
Like most of you, I got this error @ friday morning and I've never been able to log on that account since - it was a google account and the only one I've botted on. I never got a softban, I was botting in my town @ 30k exp/hour.
After that I made a new - PTC account and I've botted again, but like mad (60 km/h etc). After I hit lv27 I got first flee softban. 24 hours later it got lifted so I botted again. Few hours later, I got another flee softban. 24 hours later it got lifted, so I botted again. Then I got flee + pokestop softban and few hours later I got 'failed to get server data' error.
So basically, even if Niantic hasn't sent any mails so far, it's pretty clear that server data error is actually perma ban error.
I registered after reading this thread for few days because I'm pissed off at people that were writing how their error disappeared. You were giving false hope for no reason...
I'm done with POGO, because it makes no sense to play it unless you live in NY etc... There are almost no rare pokemons in my town. For example, even with PokeVision and custom scanning tool, I've never found Dragonite here, which is retarded. Also, 33 > 34 takes million exp, which would take a month of active playing to get it in real life so it's pointless.

Google cannot refund you since it is out of the refund window. you have to contact Niantic directly for refund. Or you could do chargeback. Apple i heard 100% back up there customers, and grants refunds.

I agree. The reason I used bot is because our place is a ghost town with only 1 pokestop. Damn. I'm done with PoGo too.

Just thought I'd throw it out there
Been playing on an unbotted account, strictly sniping Pokemon the last 2 days and I just got hit with the Server error. Never got soft banned once or made a mistake teleporting either.

Completely agree i got "banned" too, tbh it was either spoof and get pokemons or get fking lvl every year or so, every1 that doesnt live near central park, san francisco, etc. is gonna have bad unfun time. Also the game is grindfest, i can see it being fun if you have tons of ppl to play with like in central park as half the gameplay is hanging out with ppl but anywhere else it would be terrible.
