I was banned on the second wave, and I've been following the thread for a while now.
It seems niantic has found a way to stop botters, their flagging system picks up the use of a bot even if that was used once and only with the old api. It seems that a flag is enough to perma ban on a check that happens once a day so far. That is why I believe bots work during the day but stop when people wake up. I think that eventually all servers are going to run this check on regular intervals and no matter what, any account that has logged in to any bot will be swiftly deleted.
It must have been a value or something that the bots didn't send from the beginning that flags everyone.
So, I say to all those who haven't been banned yet to wait because it's coming once your server is checked.
To those who have been banned, to also wait, till we get any sort of non-automated info.
And to those who are thinking of setting up another account to bot, not to do it, as it doesn't have to do with the settings used but, with an internal flaw of the bots themselves.

I've been getting the "failed to get data" shit. I made a new account just for me to be able to **** about on the game, it logged me in fine. I tried to log in with my other account and now I am getting "our servers are humbled" crap. Any thoughts on this?

i got ban of my recently bought level 31 account which just bought 5 days ago from rpgstash .... so mean that i only using it for two day for gym battle without botting .....
my $40 gone .... so sad ..... all my botted account was ban too ( fail to get data from server )

THEN this morning when passthrough a gym , still saw my character defended the gym after 3 days .... lol ... my account still there but NIANTIC not allow us to login into it i think .... 3 days is damn torture ... ENOUGH PLEASE ....

The banning of accounts is pretty much a fact at this point, there haven't been any actual reports of accounts being deleted, all are locked for now.
Unbanning is still unclear, apparently it has happened, what would be the purpose of a ban appeal if deleting an account permanently where to happen instantly. It may never happen before some other check, the more time passes the more we learn since Niantic doesn't care to tell us.

Hey guys.

Before I start... Im a LEGIT player.. never have botted.... so why am I on this forum? because when you google for ``pokemon go failed to retrieve...`` this forum appears in the top list. So ive been reading you guys since yesterday.

like I said... I am 100% legit player. Ive been playing since the release with my 12 year old daughter. almost 7/7 after my work shift. I used to walk about 10km a day to lose weight and when pokemon go came out.. double that almost. I am level 27. On our days off we would go to Montreal (about 1:30hr) from where i live because there are TONES of pokestops there compared to 12 in the small town I live and alot more pokemons. 2 days ago.. we went to Montreal and while I was driving my daughter had my phone to catch any pokemons we would see on our way... but I kept getting that message about going to fast. Finally got to the city... and I couldnt see any pokestops or pokemons in the nearby window. Closed my app and re-opened it a couple of times and still nothing. Decided to call it quit for a couple of hours and go see a movie... got home late.. didnt open the game until next morning.. and got the message about failed to retrieve data from the server.

Im thinking that I was banned because of having the game open and going to fast? they saw that as cheating?? but worth a perm ban really??? My daughter can still play.. while i was driving her phone was charging so she would be all set with a full charged phone once in the city.

So ban... not a ban... server issues? I dont know.. but it really sucks... Every single day we went out to play and we earned all of the pokemons and levels (27 for me and 24 for her) the LEGIT way... we are still heading out for our walk... but me watching her catch pokemon and power up hers

Im gonna try to appeal... but worth it? from what I see.... hundreds of thousand of people are trying to appeal... really dont think they are reading them one by one to see if they've banned legit players by accident.

Im thinking about trying to open a new account and figure out how botting works to try and join my daughter again... like they say if you cant beat them join them... whats the use of playing legit if you get banned for driving too fast on a highway... bunch of sobes!! im so pissed.

That's awful. They seriously need to fix things like this. I've heard of several legit players getting banned. Did you know if you go in or near a best buy, your gps will freak out and port you to Mall of America then temp ban you? If not perma bans ..... so many weird bugs with gps, yet they are going all willy nilly with the ban hammer.

been botting ever since before api lockout, have 3 accounts none of them are banned, just botted around city and they are on lvl 35+, you will only be inside the ban wave only if ur stupid enough

Yeah, sometimes can be different locations, but I don't recommend going in to best buy with an account open you care about.

I want to chime in here. I have been a designated driver several times is one reason why I keep falling behind as we can't play and drive. It's not the fast driving it's a slow Sunday Drive something that was lost in this recent generation. It was quite enjoyable to have people shout out in the vehicle, my eggs hatching.

Every now and then you make a stop play at the gym go to the next gym and then collect between 10 and 40 coins that evening. There are some players that have not even selected a team yet.

It was also safer way to play simply because you were with a group of players and you weren't loitering at night.

One thing I always think about tonight tell other players is not to worry about getting high levels the reason being that they will make it easier to get the higher levels once they release the next gen of Pokemon.

This will give everyone a Level Playing Field. So what once used to give only a hundred XP may give a thousand XP or what once gave 500xp will give 5000 XP.

Edit: something also to note is that I have friends around the world with that because of the lack or inability of trading I give them my login information and they catch what I need local. It is a social game after all. Not everyone can afford Grand trips around the Riviera.

Most recent example was Comic-Con I could not make it. However a family member did. Yet no special event Pokemon what a lost opportunity for the company the brand.

After Niantic changed the API the guys from Reddit needed 4 days to crack the "new API".

They noticed that the servers from Niantic are not only asking for your position, they are also asking for your height.

Since the Reddit guys were just interested in cracking the API and not into supporting a growing botting community, they did not changed the "height" value.

So we are moving around with our bots and our height doesn't change, it doesn't matter if we are in the Netherlands or catching Pokemon on the Mount Everest.

So in my eyes, all people are talking about human behavior of bots, changing speed and how clever they are that they did not get caught.
If someone is clever he should fix that problem inside the API and maybe we can **** this shitty company again!

Of course not all will be banned on one day, it take it's time to filter and proof millions of accounts, but just this fact should make it very easy for Niantic to detect everyone using a bot, even if it was only for one hour.
