I have a feeling that u only get the perma ban if you spoofed hold gyms before.

Since only my accounts wich did that are banned. The others wich botted more arent bannned.

Well I've used necrobot on my main account only to refill my pokeballs for 15-20 minutes 3 times, never even level-up'd while botting, and it got the can't get data error. Meanwhile my second test account that got to lvl 25 purely by botting is still alive.

I don't think the issue is that they are permanent banned. I think they are only IP banned. Because all of my accounts are still up running.

Whilst it may still be coming I doubt it. My remaining account that has not yet had the "failed to get data" error was holding gyms for the last several days. My experience so far

no. i rebooted and reset my router before i even knew about this data fail error. i am able to make new accounts (and bot on them). IP bans are stupid and useless since we have dynamic IPs.

failed to get data errors are not ip bans, simply put.

I think its all because of permission, android pokemon go has camera,contact,location & storage permission. If your bot is running but they can't access your camera, BOOM YOU ARE BANNED.

I have also started bots at more human like behaviour and doing ok so far.
On a side note, the women's athletics has just started. OMG those women - are they bots? :P

Anyway, I started this new account but in my bot I'm getting the flee shit but when I play in Nox everything is alright xD

I don't have many anyawy though. just 4. My main which is being held hostage in this shit ban or not ban for life and other two lvl ok plus a new one made yesterday and already in 22

Interesting. So I didn't get catch flee until my bot hit about Lvl 24 yesterday. The other one I have running now is Lvl 18 and no catch flee at all. Perhaps much more conservative post Lvl 20? Or perhaps their algorithm only bothers detecting post Lvl 20?

What bot did you use? Because I used pokefarmer, necrobot and pokesniper and they are all good.
