But my realm list is set to EU...

Go to the USA site and download it. The realmlist just means you're connected to the EU set of realms.

I can't download the us version with out paying for it.... I don;'t have an account for us with the burning crusaders expansion already on it... Anyone have scammed account for US I can use to download the expansion?

You can go to World of Warcraft Patch 2.4.0 - US/AUS Download - FileShack - Download PC Video game patches, videos, betas and trailers for PC, PlayStation, Xbox 360 and Wii and download the patch to the (almost) current WoW version. Then auto-update from there.
