As far as I'm aware:

All names already taken are still there.
New names cannot be taken (or every name on every realm I've tried is taken.) Nevermind - still working US.

The only reason I'm sure it's unintended is because names that are clearly are not meant to be able to be taken can be - very vulgar language, lore characters and Blizzard employees.

Looks like they rebroke it and you can take names again. It is working for me now when it was not pre-maint. (This is US)

Edit: Unless someone went crazy on a lot of realms, this seems to depend on the realm.

Well this is pretty public now. People openly sell names on one realm I play on, others talk about it in trade/LFG on other realms I play on, it's been discussed on guild vent (no OC members), it's been on MMO Champ. Wouldn't be surprised if most names were taken on most realms.

If Blizz locks the names again, which they most likely will sometime in the near future, you won't be able to sell them since once they are deleted, no one will be able to create another character with that name.

Wrote Expecto patronum on the /2 with my Harrypotter and got insta logged off, and when I logged back in I had to rename him.

Instead I deleted him an created another char with the same name, and I can log in again
