What is known is that a ban wave did go out. This whole thread is proof of this. The message, "failed to retrieve data from server" DOES NOT mean we are banned.....yet.
Let's be patient and see what happens after 24 hours have gone by, maybe even 48 hours.
Here is a useful link containing information that is not fear mongering.
Let's hope for the best, but let's also be prepared for the worst.
Even 48..... *little tear falls down* but tbh I don't mind at all waiting two days if that means getting my account back. I've learned my lesson, guys! Niantic, pls stop I won't bot again, just gimme my main account back. *SORRRRRRRRRRRRRRYYYYYYYYYYYY* haha anyway, thanks for the info!
Nothing we can do about this. Let's see how it goes tomorrow or as you said, after 48h.

Finally, I was now able to loot from pokestops without "tray again later" message. Thanks God, niantic did give me a chance. I will temporary avoid to use bot at this moment. Just wait until the ban wave is over.
just give up botting and keep your account safe!

Now everythings work fine. So it was just a softban (maybe).
I will wait 2-3 days and I will try again the bots with a new account. let's see if the Niantic found a way to detect bots.
Gotta wait and see

Adding my info for insight for others. This is the info on my current stat of "Failed to get dame date from the server"
-Was botting and notice that i could catch pokemon, but not looting pokestops
-stopped the bot
-used quick spin to unban, no avail
-logged on and tried to do it manually gave me the "Try again later"
-started seeing post about "Failed to get dame date from the server" on Ownedcore, and brushed it off troll posts
- 1-2hrs later i received it as well 10pm Mountain standard time.
Now been 15 hours and nothing but the same "Failed to get dame date from the server"
from my experience, anyone who is softban need to chill and lay low. maybe you'll fly under the radar.. maybe.. lol

I agree. If you wanna bot do it to some other account, I'm betting that's not the only one you have so don't risk your main account like some morons (like me yay) seriously. Well, if you don't care so much do it though haha no one cares but it's just a piece of advice. After reaching a pretty good level you don't need to keep boting.. i guess. I only did and wanted to get to lvl 40 out of curiosity but would mostly play with my main account though. Anyway, keep up the good work and try to avoid botting for awhile, really.

I would THINK they have a legal obligation to inform that account holder, at least via e-mail, about a permanent account closure.
Have you been paying attention to how Niantic has been communicating and dealing with the game's user base at all this past month? This all seems pretty par for the course to me.

I was baned this morning ( tho i didnt got that message on my phone when i was loged) . But on bot i couldnt do nothing ( necrobot / pokecrot / haxton ) . Meanwhile i was banned i tryed plenty VPN servers and nothing was changed. Now i tryed loged on NOX . I can catch pokemons , i can spin pokestops but seems i cant go in to gyms ( maybe is a nox problem bcs i kinda lag somehow, i will try again later) but the problems is that on bots i cant snipe but with PokeSnipe i can. I used same default coords on all bots/PokeSnipe and on NOX also

Yes I have, sir. It's also commonly known that the reason for not communicating information in regards tho this specific game was because they did not have a global community manager. Once they hired one, they did in fact started to communicate changes and issues with in the game. However, I see your point, but when it comes to a PERMANENT account closure that may have monetary value in it in form of paid items, I would think they have to notify the account holder of such action.

Dude that ****ing sucks. Go request a refund from your app store immediately. Don't mention the ban just say the server keeps crashing and you are losing all your items. Maybe you can get at least $175 back.

I honestly believe a warning would be in the best interest of Niantic.. the amount of accounts that bot, and money they receive from said accounts, would be a huge hit if they just hit the dump button on them all and call it a day.. A simple email stating "you have received a X day ban for (reason). this is your first and final warning before more permanent action is taken." But what does Niantic know about logic..
Then again you also have to put into account the fact that some of these users are near max level and have an absurd amount of high level perfect pokemon, thus creating an unfair and unbalanced system which then could warrant a single strike policy... urghhh
Have people actually received account closure notices/emails? Why would we not receive them if this is a true perm ban? Unless this is a symptom of accounts that were flagged for investigation, and the email/notice is not sent until the investigation is completed?
#fingerscrossed Good luck bros.

My accounts with all the regional specific special Pokemon(Mr.Mine, farfetch'd, tauros, kangaskhan) have been locked out while the accounts with none of these pokemon have not.
