If not, let say players already spend real money in the game, suddenly cannot play and without any information or explanation provided by game publisher, player is win in the legal side of law. You cannot ban someone without giving any proof if that person violate the server rules. That is including exact log of each players and time when that player violate the rules.

    Without this, game publisher can be accused as frauding players, they can easily decide these players are not good without any justification and suddenly ban them without any reason. And that, my friend, is a violation of law.
    Once again, we have to wait and see and just like you said we can't just jump into conclusions... That's true and I agree with you. But now my question is, let's say they had erased some of the data of some players, there's no way we're getting that back now, is it?
    I'm sure this update had messed up some accounts and we're probably got stuck just like was said before and you're Niantic has no much of experience and those little mistakes can happen all the time and they're trying to deal with possibly the best they can but still, we have to wait anyway because it's taking some time now...

    And yes, another players who never bot before were having the same problem so even though this looks like a perm ban for now there's little points of hope here and there.

    once again this is company not bunch of kids. if they ban u u will have information THAT U ARE BANNED becasue THIS IS IN EULA, they need to OBEY THEYR OWN EULA. never ever ever see thing like ban without informing player that they are banned and trust me i got banned alot in alot of games, (mostly becasue i speak my mind and carebear noobs with no skill go cry to devs )
    this are SERVER ISUES made by TOTAL NETWORK CRASH yestarday morning . jsut realize that puting backups on live servers take AGES , also they introduced epic server side bugs with last update 0.33 they servers are suffering ,just understood YESTARDAY ALMOST ALL SERVERS CRASHED IN EXACLY SAME MOMENT this is not UPDATE RESTART
    becasue no one ever put down every server in same time its always regional, even ultra big corporations take more than 36 hours to reboot all they servers (blizzard) in sheldued restarts if they got crash and they did they can have unstable network for days or even weeks. if they dont find what cause the server down ( propably to much data introduyced again in 0.33 with this crap pokestop pokemon radar) they eneblade this future ins some countrys and was try in other and they crashed . also situation when pokemon server need to send milions of information that your travel to fast dont help on the network. ppl who cannot get data from server got CORUPTED ACOUNTS due of SERVER HARD CRASH, when they bring back backups it will work. if they ant to ban u THEY WRITE THAT UR BANNED the game got such mechanic and they need to tell u this becasue this is against the law to dont ( read the eula)

    Hey guys, I'm new here, but was following this section since the problem started for me, it's been now 29 hours since I can't login on my account. I have 3 acc, 2 google and 1 ptc, but I was only playing on one of them, which was google, I was legit playing, but started using bot and Nox, because I had a busy week on college. I used bot only 2-3 times, and the message "Failed to get game data from servers" is showing ever since 29 hours ago. A lot of people told me that it's not ban because you get a ban message, have this happened to others as well? I know some of you got this message too, but I read a lot of you saying that the message stopped and you could log in again. I sent 2 emails now to niantic and all I got back was that stupid auto message. I'm so angry at them right now, my only regret is that I didn't do more, like sniping and stuff. If this continues, is there anything I could try? I only tried to log in on my phone, never on the bot or others, and also, I was using bot with 6 km/h, only to farm xp and get eggs hatched. What should I do?? I'm getting desperate here. I miss seeing my pokemon! And also, if I have to start all over again with those other acc, I'm definetely going to bot as much as possible, just to piss that fkng company that never responded any of my mails!

    No one had received anything official from Niantic. Everything we got is a simple autoresponse message for those who actually sent them a e-mail from that new ban page on their website.

    my girlfriend and other friends who use bot are not banned and not getting the failed to get data server message

    stop what ? its real, just accept it and show niantic how dumb they are as they will lose more than 50% players by acting like butthurt childs..we made bad game with bad game conditions for most people who dont live in big city, so they will obviously find way to get nice pokemons other way, so we ban them and never ever let them officialy know.

    Ok, yes Niantic is a shit company but we can't make assumptions that this is a permanent ban. Again, Niantic haven't said anything about it and it's against the law to terminate someone without sufficient proof.

    if they realise that they are losing players then maybe they will let the banned ppl to log into game once again, and hide this as ,,server problems,,but smart ppls with atleast 50% brain capacity know that this is perma ban.

    @ people who claim, accounts are perma banned, if you can create a new account with the same name.

    There is currently an issue, where Niantic resets accounts. One of my lvl35 accounts, which I both played legit & botted, got reset. I.e. I logged in, it was lvl 1, I had to do the tutorial again, catch new starter & select a new name.
    The account still had the previous XP & pokemon, after finishing the tutorial, but the personal information was lost.
