Whether or not games of luck are against the ToS it is irrelevant, the OP is scamming. There's no chance for a letter to have any item in it, there's no chance for anyone to win anything, if he was reported he'd get banned.
Beside the fact that this is a lottery, it's a scam, so you'll definitly get banned for this.
If you remember, I whispered you ingame with one of my toons "No point to get banned for this", or similar, and you were on a 74 lvl priest.
Regarding the GM, indeed it very depend which GM gets on you, and in what mood you catch him. For similar action you could get from verbal note to account closure.
I've done this once. Made about 6k off it. I put 250g notes in the AH and lied and said one of them said "Winner" and if it did you won 900k gold.
