Can I retrieve my sold WoW account back?

By brother sold my account without any permission
I was away 5 months, (I guess he wanted to earn some pocket money)
came back, wanted to use my WoW account, and then the password incorrect pops-up.
Obvious thing to do was to reset the password, which didn't work as the email didn't match the account's email.
called up blizzard, retrieved my account, and then 5 days later I got an email from paypal regarding a dispute.
A dispute was regarding a wow sold account, specifically the details showed what was the transaction, the company name and the amount I owe them.
I got a deal with them to give them the account back,
my question is, can I ignore this?
I was threatened with suing me and going to court with this.
    I am completely brain fogged.

It will suck when will have to give me 8 year old account to them.

They can't take you specifically to court if you have proof it wasn't you. You might just have to give up the account; sadly it's not your property to sell in the first place, and if there is enough exchange to say "This account is for sale" then blizzard will ban you with no questions ask.

So you'd basically be fighting for an account which is a ticking time bomb ready to be banned at any moment.

Just bloodlust and slap your "brother" in the face for being a fgt, and demand money.

So your brother had access to your WoW account, PayPal account and email linked to your battle.net?

Yeah I wouldn't blame your brother..shouldn't have given him all of those infos or should've found a better way to hide your account details.

As the quote above mentions, "It's not [yours] to sell", so therefore it's not theirs to buy. The actual owners of the account gave it back to you and as a result there is no legal standing in relation to the retrieval of the account; the only issue would be the concept of "accused scamming", I very much doubt they would put the effort in to suing you due to Blizzard's ToS and the court fees.

It's illegal to scam (obviously) so if you keep the account and the money you (or your brother most likely) could potentially get in trouble.

A friend of my friend got sentenced to community service and he also had to pay equivalent to around 1000€ (afaik) because he retrieved an account that he had sold. However, this was in Sweden with both the buyer and seller being in the same country.

I don't know much about technicalities in regards to who owns what but the usual argument about Blizzard being the real owner of the account is probably not really going to work in real life scenarios like this if you were to be in a situation were you (or your brother) would have to defend yourselves. However, since each case is different it's hard to say. Since it's a company they may be more willing to take you to court, but then again they are probably from another country and then it would be much more difficult for them.

For me, the obvious solution would simply be to reimburse them the money they paid, keep your account (unless you signed like a contract that said you could not retrieve the account) and ask your brother to pay you back since that is the most appropriate solution in my opinion (unless you're able to contact your brother and have him reimburse them directly). Weird situation. Hope it works out!

It would seem to me that bringing someone to court would cost way more than what the account is worth - wouldn't make "economic" sense to do so. (Considering the account was sold for less than $1000)

Well it's hard to say. I don't know the exact English translations. (Also this apply for Sweden)

But basically there's civil law. Where a person thinks another person has done something that he believes has damaged him, then he can sue that person and take it to court like you describe (which can be costly).

Then there's also criminal law which you can report to the police (fraud for example). Then if they start an investigation and take it to court the one that report it does not have to pay because the state also thinks that it's something illegal.

If something else can explain this then please do, I feel really stupid trying to explain it because my knowledge is really limited so it sort of sounds very stupid.
All I know is that the person that reported my friends friend to the police did not have to pay anything for it.

You can also be reported to the police for this as a crime. Depending on how much the account sold for it could fall into the category of 'Obtaining money under false pretenses', thats obviously the worst case scenario, however it is a possibility. A friend of mine back in UO days caught a charge for scamming someone out of cash over a virtual item.

But like the others said, it wasnt yours to sell and its a ticking time bomb.

why would your bro sell your account but the money went into your paypal account not his?

got a feeling you scammed someone and they are doing a dispute cause they no longer have the account you sold.

buyer paid for something, you retrieved the account now the buyer is out of pocket while you now have your account and funds.

you have two options either give the account back or the money, its that simple.

and if along the lines somehow it was your brother then make him give you the amount owing, if not i'll be more then happy to watch this situation fold out on a episode of Judge Judy.

Now coming up on Judge Judy brother sues brother over funds for a world of warcraft account.

Yes, my brother had access to paypal account and wow account, I didn't know that was a problem, since I never had this problem with him, where he took something mine and sold it, till now. The account was sold 5 month ago, $90 for the account. It has 90 level characters only and it is MoP enabled only.

You know what?, I am going to test this out and reply to you within 2 weeks, when the paypal dispute ends. If something happens then I will just give the account back and reply my results here, I hope it helps other people who experience this situation. as this topic is could be about hacking too.

    Someone hacks you
    sells the account

    and then what?

I hope I will get the answers.

Paypal can vie logs of ip's that log into the account to check if your paypal was hacked.

a bit stupid someone hacks your wow account then sells the account and the funds get transferred into wow account holders paypal, then claims i got hacked !!!

regardless if you got hacked or not the buyer is out $90, your account had the $90, paypal will chase you for the $90 not the person who you claim logged into your account. It's in paypals terms and conditions you're responsible for all transactions and purchases that happen on the account.

Paypal will rule in favor of the buyer so get ready for your account to be negative $90, if i was you make your brother pay you back.

Also where has the $90 gone? did your brother withdraw it into his bank account from your paypal? If so when the dispute ends get paypal to withdraw funds from that bank account.

The hacker can sell it privately without using paypal.

My paypal had balance of $90 then he bought something using paypal payment service.

I am guessing the last thing to do, is to call up paypal or via livechat and explain the situation. The account got sold without my permission. If i can't keep my account, then I will return it back or get $90 and send the money to the company.

I would just give the account back paypal is likely to notify blizzard at some point. The account will end up banned if they do.
