    Is it illegal to recall my account?

    I sold my account to toonstorm a few months ago, everything went smooth for me. My friend recently bought a character from them (due to my recommendation) and the account got banned within 24 hours of him buying it, toonstorm wouldn't refund him and is pretty much ignoring him

    If I recall my account it isn't illegal right? It's been a while and I armoried. my characters so it hasn't been sold or anything, no one has played on it since I sold it to them.

    I figured once I recall it I could give to my buddy and he could put an authenticator on it to prevent any shenanigans on toonstorm's part, as they have a bunch of my personal info.

    Before I do anything I just wanted to make sure it wouldn't be illegal.

    It isn't illegal to recall your account, because selling/buying characters is only against Blizzard ToS, and not against any law. Every WoW account is actually Blizzards account, you're just "borrowing" it. In conclusion, it isn't illegal and you can't get sued or something similar by some third party.

    Nope, only Blizzard is allowed to trade accounts (which they never did), so no.

    actually it is illegal... You sold something and then you take it back.
    Imagine having bought a house and then after a holiday the old owners have taken it back.. so you are now left without a house..

    The EULA , TOA is not valid in all countries.. He is recalling it in "Bad faith" so he is aware that he is doing something wrong... and that is why it is illegal as well.

    Well, technically, I don't believe it is "illegal". It's illegal to trade it in the first place, so I don't think recalling it is illegal.
    In my opinion. Is it immoral? You bet. Is it "Illegal", and will action be taken upon you? Probably not.

    You guys are all talking about copyright law and the rights of Blizzard. Who cares about that?

    If I was scammed by someone, I would immediately sue under a tort of negligence.

    Even if you do not own what was sold, you had a duty and you breached it. This caused me an injury of some sort, after a proximate cause. You will lose, because you can't mistakenly recall an account with no ill intent.

    Now, let's talk about criminal law and not civil law. I see it that you commited fraud. I'd probably sue you for that, plus a few million in emotional damages as my WoW addictiona can't be fueled by you taking it away from me).

    Well I don't know but it reminds a bit of a situation where you'd be selling a console game to someone through mail and you both know it's a stolen one, but once he have sent the money, you will not send the game. Sounds somewhat illegal at least some part of that, but probably nothing going to happen in such small scale stuff.

    On the civil side, you can recover the total of your damages, if you show you tried to recover from them. If the account costed you $1000, that's what you recover. You can also recover any other damages related to the topic (but-for the infraction; if not for it, none of these damages would exist). Sometimes this can include court fees too.

    On the criminal side, the individual broke the law. Fraud is commonly illegal. Stealing isn't generally legal either. Making an agreement to sell something and then stealing it back is most definitely illegal. Now, you could argue that the contract made was invalid due to Blizzard owning the intangible content anyways. However, that doesn't excuse the misrepresentation and ill-will that the defendant had to pursue. It was still a wrong versus society, particularly versus you, the Plantiff.

    In any case, it's a cut and dry case of you, the scammer, losing.

    Hey,
    Just do it. You can really argue if its illegal or not.
    They messed around with you, do the same.
    People dont need to always think about if something is illegal or not. In the end the stronger will rule.
    However, nobody can sue you for it, especially not the site that you want to get your account back from.
    They dont even have the resources for that.

    You are basically stealing money by means of fraud. It's not toonstorms fault it got banned your friend chose to buy the account which is against Blizzards Tos. It also portrays you as a member on here as a scammer whether you have scammed elsewhere or on here nevertheless.
