Depends on where you live, like that girl that lives across seas, she hacked her husband's maplestory account and she got sent to jail because it was considered his property. Afaik, phising is illegal no matter what your doing, I may be wrong, I don't scam people so I wouldn't know. Maybe ask the WoW Lawyer?

Oh yes. its going under that Technically illegal department. seeing as, once you scam some ones account, you then are using there money to pay for membership, and since most people use a credit card, it can be considered credit fraud, which is a big deal. now, noticing your rep and all, you probably don't scam much, or know how. i would really test it on your friends first, act like a totally different person to resemble a real scam. and if you succeed in taking their account, give it back and do not be a dick. its good for the both of you, you learn how to scam, they learn how to be more careful. Back to your question though, its illegal, but the chances of you actually even having a lawsuit on your hands is SUPER slim. unless your a total retard and tell them your name and personal information while in the process of scamming.
