Have you tried using a DirectX approach for drawing? I think thats the only way your going to be able to load a interface over a full screen DirectDraw.

To get this "Can you get banned?" thing sorted out, I will talk to a GM right now.

Honestly, I'd check out CEGUI to do this type of thing. The SDK they offer is incredibly extensible, and offers just about everything you could want. (Minus the browser control)
