You need to have 2 accounts to do this. Create one lvl 1 on the new server whit the same name as you are going to transfer transfer. Rename.

It wont work if its on the same account blizzard will delete the low lvl one

This is just not true. Please don't post if you're not sure about what you're saying, because it confuses others. The transfer is an automatic process. Your main character will be flagged for a rename.

- no, blizzard won't delete any of your chars even though it's lvl 1

If you say i'm talking rubbish it's ok, but please be fair to explain and don't just say "this will get you banned" or "blizzard will delete your char" or "this doesnt work" when you in fact don't know what you're talking about.

This is tested and working on live servers.

It does work on the same account... in fact, I've done it with the exact same character three times now.
