It's in Germany. The Terms of Use are Blizzard's responsibility, so the case will either focus on the Licensing (EULA), or reverse-engineering, like Warden. Hopefully German courts aren't as easily bullied like American courts, making for more reasonable arguments...
Good luck to the HB guys, companies need to stop using courts to enforce their own rules.

Money is power in this world and Blizzard have alot of it. Period.
