Nope since downloading it from the net like as a torrent is not illegale.

Along with what 2d said, Blizzard itself offers the download directly from the site. (They offer downloads via trials, both for Burning Crusade and Non-Expansion, I'm sure they'll add WoTLK in the mix as well soon) You wouldn't be able to access any content even if you had it downloaded on retail servers.

Considering you can download WoW for free off of worldofwarcraft.com, there's no such thing as an "illegal download of WoW."
