Regarding the mainsteam bots (Glider and Openbot mainly), you can only be banned by 2 ways:
A. You get reported.
B. Blizzard changes Warden or the game client to detect the bot, then waits for a little for botters' names to build up. All bots try to be non-Warden detected, and they are, 98% of the time, but sometimes Blizzard is a step ahead of them. Anyway, when they detect a bot and then sit around for a while waiting for lots of botters to be detected, they press the big red ban button on a certain day, and every single person on that list gets banned. This is known as a "ban wave."
As for being reported...you'll just want a bot that makes you look as human as possible. I'm not sure which one is best for that. But, the best thing to do is to bot on a low pop server, in a low pop zone, at non-peak times, to reduce the chance of someone observing you. Also, set alarms so that if someone talks in say chat, whispers you, or follows you, a sound will go off, and it will be recorded in some sort of log.
If you suspect you've been reported, don't bot for about 2 weeks and you'll probably be fine.
As for ban waves...every bot has been hit by ban waves before. Openbot used to be safe for a while, but 2 of the most recent ban waves hit Openbot bad, which makes them lose a lot of credit.
For BG AFK bots...if someone reports you for AFKing or just non-participating in any way, bot or not, they will suspend you for a while, remove all of your honor, remove all of your BG tokens, and remove every single piece of your honor gear, even gear you bought before you started AFKing.
