Could probably do it just once without getting banned. If you do it 100x and flood the AH with ore, it's more likely you'll get banned. Just once, and you could say you canceled it for some other reason, and didn't even notice that resetting is what caused the ore to respawn (because if you had noticed, you'd have probably done it more)

Mine is level 1 and im upgrading to mine level 2.

It is working fine, you're just suffering some of the garrison bugs. Try a reboot of WoW or wait and try later - I've had it working off and on while facing other garrison problems.
