Were to host a server legally if possible?

I am looking to host a private server, outsourced in another country were blizzards tos, eula and copyright/trademark do not apply.
Is there such a place. I'm sure there is... but were is it.
world of warcraft is yes worldwide. but the tos and eula / copyright/trademark can't apply everywere.
Were does it not apply?

I've heard of cases where, for instance if you are being sued in Serbia, you use the "I can't understand your TOS because it's not in my native language and I don't speak English". Rare, but I've heard a few of those worked. Using that logic, you might want to pick a country that has some random language nobody speaks =)

Its generally working, for coutries without popular language, but still, I doubt your server will get strong enough, so it will drag attention to the Blizzard legal staff.
I guess, its better idea to start the server firist, and when its runing well, to think about moving the host.

Sweden is fine, but its not legal, encrypt your dbc and maps files.
Or just have the hdd close to hands and smash it.

but don't make money or a shop with it.

And then you won't have problems there since the EULA, etc. doesn't apply here :P

Just host somewhere in EU, blizzard is not targeting private servers atm. They are just slowing down the emu development with their new shit.

This, but not intentionally. Not many developers work publicly any longer, but private emulation is still strong.

Blizzard don't seem to care about private servers at all. They have not done anything to prevent it. They do go out of their way to target bots with specific client side and server side implementations though.

Worst comes to the worse, you just get a C&D and stop with no consequences. But even they haven't been sent out to private servers in a long time.

True, they took 3 servers down in 8 years? and that's because those servers disregarded the warnings they got. And im prety sure they won't target target any private server untill they will drop to 5 mil players.

Well it depends on what is sent. Generally when a C&D is sent private servers shutdown - only one hasn't (WoWScape) which ended up costing Blizzard a small fortune in legal fees. Peyton, who was prosecuted, cannot repay what he has been told he must so Blizzard did not profit from it. It was more of a publicity stunt.

It is possible they don't send C&D letters now in case they are ignored. They must follow up a C&D to maintain their reputation yet it will cost them greatly when another server will spring up in seconds.

They could make emulation much harder for us if they wanted instead of taking the route of targeting specific servers. This is why I suggest they simply don't care.

Molten-WoW got a C&D for their website only, which hosted copyrighted material (images). They simply changed that and then they were all good.
