It does infact break the ToU and some other "laws", the list goes on.

    -Copyright Infringement
-Statement in the ToU above about redirection of the protocol.
-Statement about packet sniffing and RE in the ToU.

Yes... they have Blizzard's intellectual property (parts of) hosted on the site., could easily be taken down. I'm no lawyer but I'm on track, I remember when all the stuff was taken off GotWoW? because they had things like there spell database, emulators, etc.

Well from what i've heard is you can host a server but when you start getting people to pay to play thats when it becomes a legal issue. Besies that donations are ok, since they help maintain the server and bandwith along with other hosting fees!

Read the excerpt again. Even if you don't get paid, it's illegal.

they can't take arcemu down... arcemu source without DBC and maps and the DB includes nothing of blizzards stuff.
Like most emulators prolly for "Educational purpose"

Well client wise if you copy the wow files from a PC onto a external hardrive and put it on anotehr PC you can load it up on that PC completly bypassing the ToC that pops up. So you could technically argue that you have never agreed to the above ToC anyway
