Niantic bans people randomly, not in an order. You'll get banned eventually. You can say goodbye to your account, take a few more gym while you can.

I'm starting to lose patience now. if they are gonna ban me then do it now so i can move on with my life. right now all my accounts are still OK.. including two that i've Haxton'd before. I've NOX'd on all fo them beacuse the game isn't worth playing without it IMO.

Nobody can tell anything, Niantic right now are being SO clever keeping their banning proper to those still using bots & still being as bad as they were by not banning the ones botting, so they're just doing half jobs.
Noboooody can tell when they will get banned however, IMO, everyone that has cheated is flagged, however still dunno why the ones that have escaped HAVE actually escaped. Dunno, this whole thing is so frustrating to everybody!

I've thought about that before actually. But if they do keep a backlog all the way from day 1, then you are basically saying that they have the ability to press one button and immediately eliminate 99% cheaters in the game. IMO that is a huge overestimation, and they are insane not to do it, because cheaters almost ruined the game last month. It was kind of a joke that every gym you see was being controlled by a 30+ however... i dont disagree with the rest of your OP because clearly there are parameters and flags in the system that targets certain accounts.

unless if you are a hacking/coding expert and you managed to emulate a real human playing on a smartphone through a bot, you will get banned.
niantic rolls out bans in waves, and somehow when you have logged in on a real device with your botted account, you get banned a lot faster.

The first ban wave on Saturday hit 7 out of 10 of my accounts, and after checking to confirm that I still have 3 accounts working, I didn't login to them anymore. Yesterday I tried to login them to play on phone, and found out that 2 of them were banned.

From the above, u conclude that bans comes in staggered waves. Accounts were marked beforehand, and banned in different days. Niantic probably is doing this on purpose to make it hard for us to find out what causes the bans and make us think our accounts are safe, then hit us on a later date.

That's only when you have an account banned and have actually logged into the banned account with that phone. That probably flags other accounts that have logged on on the phone. That's why you've some people that play legit onto 1 account get banned in the legit account aswell. Probably. Most likely. (Not sure)

because that has an influence on the legit players, when you bot but you dont actually login on a real device, chances are low that you are taking over gyms or showing off to legit players

The real question is when are they going to update the game... They claimed at a conference that only 10% of the content of what they plan to implement into the game is actually implemented. Until they actually make the game more interactive, botting barely plays a role.. only gyms which are kind of a waste of time anyway at this point. Even if you have a lvl 10 gym with 10 3400 dragonites 3 noobs can conquer that gym with half as good pokemon since its 18 vs 10. The whole system needs a revamp. You can't hold a gym for more than 5 mins in a major city. Catching pokemon all day is becoming a bore to many players. I'm not sure why they are so focused on getting rid of the cheaters with a non interactive game.

Lol plenty of people have escaped including myself. We just knew when to slip back into the crowd when Niantic turned up the heat.

You just haven't been hit yet. Your reckoning will come as well. I stopped botting weeks before the API lockout on several of my accounts, all of mine are now dead. They all died with several days in between each banwave.
