Any 40lv botter still survives without any kind of new bans / perm ban till now?

my main acount isnt real special no 3000cp+
no strong dragonite lapras or snorlax
but its level 42
i have been playing it since the app came out
first legit to level 18 then i botted
i have 3 pokemon away on pokestops
so far no ban (A)
i also have a level 31
same thing pokemon in gyms and no ban
