In case you're out of the loop, WoW Glider is a 3rd party application that automates all major aspects of gameplay. You set the parameters and it starts farming loot, experience, reputation -- whatever you'd like. This is, unsurprisingly, against Blizzard's terms of service -- those things you have to click agreement to before you play the game after every patch. But this lawsuit isn't just about whether or not WoW Glider breaks the terms of service: it's about whether or not Blizzard has the right to kill the distribution of WoW Glider. WoW Glider's complaint suggests Blizzard has been attempting to strong-arm them into stopping distribution based on alleged copyright and DMCA violation -- and WoW Glider's makers are jumping in with the first lawsuit, which (and, no, I am not a lawyer) seems to be asserting their rights to distribute WoW Glider and telling Blizzard to back off. he is suing to prevent getting sued... he is suing cause blizzard has threatened him trying to make him shutdown glider.... which he wouldnt, they said it was copyright infridgement with the game.

Look's like they have a vengance from the new patch, how it's mass banning beacuse of there program, they probably recieved numorus complaints, so there sueing. It's probably also to prevent from getting sued like previously stated..

from what I understand from reading the PDF, glider isnt infringing upon the TOS, this could get interesting, I hope Merc gets the upper hand and shoves it in blizzard's face for being idiots.

merc is suiing the to prevent it from happening, because blizz cant sue for anything.

lol...This should be interesting to see how it plays out,but it would be great to see this come back into Blizzard's face, since they are probably thinking that this is no big deal and they will win.

If this goes to court, glider will be counter-sued by Blizzard. that is a promise. Blizzard wants to keep the "upperhand" in this aurgument, and if they allow the "opposition" to make the moves and become the prosecutor instead of the defendant, they lose the image of the "good guy" in a battle against a group of "Hackers".

Gliders main argument will have something to do with Blizzard trying to run them out of buisness and could almost say something about Blizzard having a phobia, which is most likley true. Phobia's are caused by 3 feelings.
1. Fear of the situation
2. Not enough knowledge of the situation
3. Jealousy, or uncertain of ones feelings on the situation
In Blizzards case, i would say there phobia is mainly caused by #1. They are afraid of losing control of there game, so they crack down fast, and hard on all situations that could compromise there control of players in the game.

i see this all the time with big buisness, little man cases as i like to call them.

Though glider has a decent argument, the general public doesn't know much about computers and so they jump to the conclusions that if you have a program that can play a game for you and, you are a "Hacker". Once again, the term hacker is being misrepresented by a computer illiterate person who is most likley afraid of computers and the power that they have in todays society.

Blizzards argument is also a decent argument. they do have end-user agreements that mention no external programs that are not validated by Blizzard, so on so forth, which will be there main topic and point in this case.

it will be interesting to see what comes of this battle between two companys based over the internet, and how they will handle to problems proposed by both sides.

this is just my take on it.......
