I'd be curious to know this too. I bot 2 accounts, 1 was my old main account with lots of characters and GAH/RMAH use, the 2nd has 1 character and it's for botting only. On both accounts I do a fair amount of GAH and still use the first for occasional RMAH use (selling mostly).

I'd like to hear if there's anyone who's 'main' account in which they've used RMAH on has been banned due to botting. And OMG it's like 1am here and 80* F out here. Hate summer in cali!

Point is it doesn't matter what state your in, location is irrelevant fact of the matter is you broke the TOS. Anyone who assumes blizzard personal actually review accounts individually before banning don't have a clue how the corporate word works. Time= money and that would be a huge waste of resources.

The only time a human being looks over your account is if you DISPUTE it which would be stupid as **** especially if they log data which would be evidence against your case. Do you realize how complex it would be for a human being to decipher all those logs of information? That's why they code a system that detects a bot and is far more efficient than multiple individuals monitoring. At the end of the day if the system BANS a legit user that person will of course dispute the ban and most likely win after a human reviews. Botters never dispute its pointless...

Botting 24/7 4 weeks straight NO BAN YET. KNOCK ON WOOD!!!!
To close the account is a measure that is too strict in my oppinion.
Especially when they have no proof that they really need to present to perform such an act.
A more reasonable measure would be to delete the character Which in this case has been botted but still keep the account, it is a harsh enough punishment that should be enough.
For Blizzard to present proof that a program has been used, they need to go into your computer and read the memory cards and determin your hardware ID which gives exactly the information they need for an account "manipulation" for a closure.
The reason for the hard measure bottoms of course in that they earn less money for every bot That runs around and blizzard does not want that at all. They have the tools to detect characters that moves just the same with the help of the profiles with its cordinates, and I mean the profiles that we use as several hundred others aswell.
To edit the downloaded profiles is a good idea to stand out from big picture.

Appealing against their actions are in my eyes of course something everyone should do.
I did it when they scolded me in wow due of a third party program, I countered that I wanted to have grounds for suspension and of course the evidence.
I received a reply on my ticket:
"After a careful investigation of your account warning, We have AGREED to remove the warning and suspension of your account from the World of Warcraft servers.

This change speed Already been put Into effect, and your account Should again be available for play.

Also We have removed your Recurring subscription details from the account, you goodwill not be billed again on this card unless you enter the details manually again. Once the current subscription is over, if no further payment details are added, your account goodwill Become frozen

If You Have any Additional questions or Concerns, please reply to this ticket and we'll get back to you as soon as Possible.

Just wondering if anyone in the EU would like to clue me in with details on how to get the ball rolling on a class action? Since ToS and EULAs were just recently thrown out the window by your courts it seems a pretty good way to screw blizzard over.

As far as I know class actions aren't as easy to certify in the EU. Different countries still have different regulations? I'm just hypothesizing here, but since global play is enabled and people are able to select European servers, there is therefore justification to file in the EU even if you don't live there.

Ambiguity favors the party who did not write the policy, unfortunately gamers never unite concerning "fair language" and Blizzards denial of clarification.

I cant blame the service reps, internal policy most likely prevents Blizzard employees from setting a standard. Jay Wilson himself stated that a ban from using of Dark3d is "not likely".

"Not likely" is the best comfort you can offer Jay? No matter how high on the food chain, they won't set a firm precedent.

To get anything done your only option is via snail mail directly to Blizzard's legal department (yup, snail mail, no email or phone number is provided). You'd need hundreds (read:thousands) of jaded gamers willing to stick together to get something amended.

That may be true but it's obviously slowed down considerably.. I mean if they were banning in the last several days there would bound to be some reports in this thread or over at DB forums but there hasn't been in days. Whether there has been bans or not is up to debate for these forums are simply a sample size. Regardless, its still intriguing.

Don't worry Prooz, you are right in believing the banning has slowed/stopped as of the last few days.

Garbage however is right as well, it could start up again at any moment. Maybe with new item patches etc.?

I think a very large % of people who have been banned haven't purchased new accounts to start up again and the market is really reflecting that. Last week if I put gold up on RMAH, it would take around 30 hours before it sold. Now it takes 3. Maybe people will start up again, but I think the majority of botters have moved on to something else.

Nope, still not banned after 100 hours of botting(not botting anytime soon though). So lucky that i had a script that used 42 sec each run.
