I was going to post something very similar, but I saw that you had posted in this thread, Cypher.
It's illegal to do, yes. However, blizzard doesn't seem to care about simple model edits like gearswapping / mount / character, as you don't gain an advantage over anyone by doing so. It's purely cosmetic on your computer.
They do ban people who exploit, though. Like removing gates battlegrounds/arena, and people who change campfires into gigantic stairs or create underground paths to for instance Baron in Stratholme so you can farm the mount in a minute instead of 5.
I've been using skin edits (mount/gear/chars) for almost 6 years and I've not been banned or given an infraction. For that, anyway.. Verbal abuse not mentioned.

No, it's not illegal. It's against the rules of the EULA but Blizzard doesn't make the law.

to the OP, some model edits gets you banned these days from what i know. kynox posted about it in his MEfix thread how certain model edits would get you banned because of detection.. Battleground edits is a good example of this if i remember correctly

No really, as everyone else says, some certain model edits will get you banned, and I guess you CAN, in very rare occasions be banned for gear swap and stuff like that. However, the chances are so small that I would not even consider it taking a risk if you do it.
Legality has nothing to do with an EULA stated by a private company :P
