how do i confirm last name given ?

Couldn't he say that he got married, took his wife's last name and just photoshop a marriage certificate?

Yea that is the only way short of creating an account adding expansions ect. and you dont want to spend the money first. Really if the name is wrong, the dont make a big deal, you wont, to the best of my knowledge, be written up for this.
Just call up blizzard account and billing 1-800-592-5499 for the US, not sure for EU, taken right from their site. Tell them you want to change your email or something. They will tell you if the name on the account is wrong.

You can "confirm" the last name given.

Create a new trial account with the "given" last name.

Attempt to transfer a toon from the main account to the trial. It will return an error if the last names don't match. Or it will let you proceed if the last names do match.
