It depends...who you are scamming, how you scam them, if you use malware or viruses, impersonate blizzard, fake IDs, etc.

Yes, if you use keyloggers and stuff then that is illegal. Its considered tampering among other things.

However, the actual wow account is not considered illegal. Blizzard owns the account and can do whatever it pleases with it. Legal action can not be taken if you steal a wow account.
