Of course it's not 100% legal, but the police will do NOTHING if you scam a WoW account. They couldn't care less. Also, honestly, most people that fall into scams are 12 years old n00bs, do you imagine them going to the police crying? They will never do it.

But make sure you don't scam credit cards, Paypal accounts and stuffs like that, unless you want to go in jail.

Yes. It is. It's Intellectual Property theft. There have been several arrests made on world of warcraft, second life, and other such MMO scammers. Google if you don't believe me. Even scamming gold is illegal. You don't even know how many laws you are breaking when you set up a phisher or scam somebody on a forum. The only thing is that in truth, consequences in these types of crime are very rare but they CAN and DO happen.

Source? Show me one case where someone was arrested for trade scamming.

Phishing is obviously illegal, but that's not the question that was asked. Going on Markee Dragon and, say, trading someone a trial account when they thought they were getting a level 80 hunter, and then taking their account does not break any laws.
