The ultimate risk is permanent ban. But if you do things right, and know when to stop, you don't risk much.
It all comes down to whether you know what you do, and whether the scammee really wants to get back at you or not.

lol no, the owners can't do anything about it except complain, it says in the Terms of Agreement/Usage/?? that blizzard owns the account, you are just renting it from them.

Scamming people in-game for gold and such is unwise, as it will usually result in a ban.

There are no real reprecautions for scamming people's accounts, but just keep in mind that it's incredibly easy for them to get their account back after you scam them. One quick phone call to Billing and they'll have that account back faster than you can say "recall."

Well if you're scamming gold sites, just make sure you don't give them your paypal e-mail address if your paypal has your real phone number/address/name/ect. So make a "scamming paypal account" if needed, and put in fake info.

And be careful receiving, sending, & carrying around large amounts of gold. If Blizz gets suspicious and starts keeping an eye on you, you'll get a ban (either a 3 day or most likely a perma)

another thing you can do if you are scamming gold sites, is create a guild bank.
Make an alt, create a guild, buy a tab, invite some noobs in, and put all the gold there. (dont give anyone the access to the guild bank ofc :P). That way you can store your huge amounts of gold safely
