From my Experience, As long as it's not music, Movies or TV shows, You'll very rarely have anyone say anything.

Oh and most the time, They'll mail your ISP a letter, Then your ISP will call you and give you a cease and desist order.

Why would your ISP give you a cease and desist, odds are your not hosting it locally. So your ISP wouldn't care if your hosting a illegal version of vBulletin on a hosting service.

Depends if you have enemies...if you get reported your forum is pretty much screwed and in the best case, taken down.
But as the previous poster(s) said, depends on content as well.
Warez == highly illegal unless hosted in Indonesia.
