2. No, you must login one time, when legion starts to get the tmog on your battle.net account.

I got banned for using 3'rd party programs, and i have a wow 2 and i got banned on wow 1

so i dont get my stuff ?

We don't know how that system will work, but if it's like heirloom then no it won't transfer over unless you log in once.
