Chance of getting banned account back

So the story so far: I got my Account banned with the Herb Dupe Exploit.
The story behind the account was it was original the account of my Brother(with name etc),we shared it in Classic,and with BC he moved on and got his own account. So with LK i merged(his) with my own Battle.net and so it was on my name.

My thought is if i act as my brother and say i remembered my old account and was wondering why i can't merge it with my battle.net ... you think there is a chance it would get unbanned and merged into a new battle.net?

What do you mean exactly with that statement?I'm afraid im not very familiar with some vocabs ... so maybe you could write something more What first offence do you mean?

With dupe exploits in particular, they've stuck to their guns 100% from what I've seen and heard. I lost an account to this as well, waited almost two years before even contacting them (wanted a peek at WoD) and they still would not budge. Better off either just buying a new game on the same bnet to get your mounts/achieves or do what I did and forget about WoW all together.
