Disclaimer + Phisher = No Trouble?

I was thinking about making a fake login page. But many people have told me if you get busted, your going to jail.

If I have a disclaimer saying they are giving their username and password to me, and I am not associated with Blizzard in any way, and they have to check the I agree box to get in, can I still get in trouble if I get caught?

I have a nice scam in mind where they have to check the disclaimer box to get to the phishing page.

in this case the disclaimer will not save you , when you setting up this page you are automatically breaking the law and no disclaimer or "only for educational purpose" sign will save you , the only thing that you can do is use TOR or any other anonymizer

PS: you can try get from Blizzard a license to use there content for internet fraud )
