Need help on keeping a scammed guys account

Hello ppl

I got a lvl 70 hunter on my hands, with quite some decent gear, and I want to keep it. So far I got the email on my side, i know the SQ and the account owners last name.

I was wondering that if you make a similar account with his last name and first name and then transfer it and then run a cheat program on his original account to ban it. Will he be able to get the character back even after i transfered it?

You COULD make a new account with his last name and transfer it over there, but Blizzard can track such things, so it could be risky.
If you have his SQ you could keep recalling his account if you have access to his email.
