I'm not a lawyer but I believe depending on the country it is actually illegal. As in you're breaking the law.. I don't think you'd get jail time but maybe a fine or something. If you're talking about legal in the terms of ToS then no It's not "legal" and they'll ban you for it if you get caught.

You're simply overwriting one map with another. The client reads the most recent data first. So any custom content you add will be read and loaded before anything else.
This is why all old .mpq model edits you'll find will be called Patch-4-9.mpq or Patch-x.mpq (X being any letter.)
All the npcs in the original zone as well as any Gameobjects are still going to be there in the map swap. (As they are server-side.) You'll also see any players and they'll see you.. Which means if you're walking around in Emerald Dream they'll see you floating through the air, going through objects ect.
(Yes, I took this on blizzard's servers. And, no.. I didn't get the mount.

Same here, I just figured it out the other day on accident lol. (It only works in Gilneas btw.. Not every sticky wall.)
Once you get over to the Dalaran side of the gap the sticky walls end but it's almost the exact same as Phase 1
