The character will still remain in all of blizzards data structures. The only "difference" between character A (the one with forced rename) and character B (the one you created with identical name to that of A) is that A now is named+random 5 alpha-digit hash-like string *1*. When attempting to enter the servers with this seemingly invisible post-name "hash tag" (I'll just refer to it as this even tho I am aware of the erroreous name), the server will send back a package that essentially tells the client "The name is invalid. Start the procedure for renaming". This repeats until the name is no longer invalid; at this point the server responds with a simple "Welcome" package. I'm quite sure you will still find evidence of this procedure in the open sourcecode that is available on the web for the game. Unfortunately, the game is not developed with open source code in mind, so it is of course outdated as ****, as the only source code is something probably stolen or something along those lines. But, you will find remains of this.
As a matter of fact; anyone who has migrated a character can probably attest to this; IF you have migrated a character from a low-pop realm over to a high pop realm, and your name was "generic" enough, you probably logged in to your character with this "wierd" thing appended to the end of your name. The reason why YOU cant see 2 people on armory or ingame is simple; your character has never been online on the new server; with its previous name.
I guess its kind of weird that after a transfer, the tag is visible; after a gm forced namechange, its not.

Did how you explained but i could not take the 1st char name even it was flagged for rename.
Your name must be changed to a new one by blizz, if they simply gave you an option to rename - it won't work. However I suppose it's possible to achieve the same effect by choosing a new name, starting entering world and closing game via alt+f4 (your goal is to change character's name without actually loading). Then you can create 2nd toon with the old name.
I played with something similar weeks ago, you can simply create a new char, then delete it, and create a new one with the same name. This way could be used to post to forums if you really want to use same name with 2 or more chars. Same way you could probably make armory show 10 chars with the same name on the same server (for a short time), and no need to use reporting/ban.
You can also put up auctions with several characters that all have the same name, even on both horde and ally side at the same time, and they stay there until expired. But I found out that when the auctions are bought or returned, as well as returned mails, it won't get back to any new char with the same name. I think the game handles auctions and mail returns based on char ID and not name.
