    2 ToU loopholes: hired teammates; account inheritance

    IANAL, but if I'm reading it correctly, there are two exploitable loopholes in the ToU.

    First, it doesn't stop you from paying someone real money to raid or run arenas with you, as long as they use their own characters and not yours. So offshore farmers could hire themselves out to raids or arena teams that either had a slot they couldn't fill or wanted to get carried. They could even charge extra to pass on loot.

    Second, they say you can't "purchase, sell, gift or trade any Account", but I don't see anything that prevents you from leaving an account to someone in a will, the executor of your estate from delivering it, or the heir from receiving it.

    If you can suggest a better thread for this, I'll repost it there. I don't see any better place to post legal loopholes.

    They can ban your account for whatever the hell they want, or for no reason at all.

    well for starters you dont own your toons or your items so to will off something that isnt yours cant be done. For 2 this isnt an exploit just a thought process. What you say might be right to you but you got to understand this is WoW they ban 24-48 hours for haven an idea you MIGHT be hacking or breaking the tos in some way.

    Well, I read what you said and let me just say a few things for you. First off I read the ToU and found that your statement is not valid at all.

    No Ownership Rights in Account.

    NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, YOU ACKNOWLEDGE AND AGREE THAT YOU SHALL HAVE NO OWNERSHIP OR OTHER PROPERTY INTEREST IN ANY ACCOUNT STORED OR HOSTED ON A BLIZZARD SYSTEM, INCLUDING WITHOUT LIMITATION ANY BNET ACCOUNT OR WORLD OF WARCRAFT ACCOUNT, AND YOU FURTHER ACKNOWLEDGE AND AGREE THAT ALL RIGHTS IN AND TO SUCH ACCOUNTS ARE AND SHALL FOREVER BE OWNED BY AND INURE TO THE BENEFIT OF BLIZZARD

    Account Suspension/Deletion.

    BLIZZARD MAY SUSPEND, TERMINATE, MODIFY, OR DELETE ANY BNET ACCOUNT OR WORLD OF WARCRAFT ACCOUNT AT ANY TIME FOR ANY REASON OR FOR NO REASON, WITH OR WITHOUT NOTICE TO YOU.     Blizzard clearly states that they can suspend, terminate, modify or delete any account at any time for any reason. They also clearly state you have zero ownership rights of the account. If you was a lawyer and used that terminology one could say you are allowed to have a gold farmer log on your account and farm you items by hand because blizzard states in another section of the ToU that there is a rule about no third party programs so if a gold farmer logs on you did not use a third party program. In the long run you need to read the whole ToU before coming up with a conclusion..

    There was a huge thread about this on mmo-c a while back, not on the very points that OP mentions here but many people were stating that despite what Blizzard lay down in the TOU, much of it would not stand up in a court of law.

    AFAIK The account belongs in full to Blizzard, and always will. The account 100% belongs to Blizzard, you just pay to use it.

    So, to sell an account, all you have to do is find a buyer, visit a lawyer and name the buyer as the heir in your will, and then kill yourself. BRILLIANT!

    i just chortled out loud in class, and got some strange looks.

    Best part of this is.... if you're actually passing an account to someone who you're close enough to that you would name them in your will... why not just give the guy your account info? OP may have noticed that he doesn't have to provide a blood sample to prove he's the actual account owner each time he logs in, right?
