Is this bannable now?

This has always been a violation of the ToS and as such, has technically always been "bannable". See the following section in the ToS:

9. C. (i) Using or exploiting errors in design, features which have not been documented, and/or "program bugs" to gain access that is otherwise not available, or to gain a competetive advantage over other players;

The only difference is that now, Blizzard has officially notified us all in the patch notes that they've tried to fix it.
