they CAN ban you if they find out. And I hear they have a program that looks at the taskbar and checks stuff out however if you do not have any private server stuff running while you are connected to blizzard then you have no problem.
OBVIOUS BUT: DO NOT TALK ABOUT IT ON BLIZZ SERVERS AT ALL.
They don't Ban people for saying "Private Server". Every now and then a guild will talk about something like say PRIVATE SERVER!
How would they detect it ? -.-

Like I said, they do not really give two sh*ts. I've asked a GM if it was ok to host a private server (Back in my noob days.) and he answered with, "It's against our TOS and I wouldn't suggest it, but just between you and I, they won't go after you."
A friend of mine TOLD a GM that he was hosting a private server, and he did nothing. They don't "keep track" of your computer or anything that you do, they simply do not care.
Since I no longer fear getting banned, judging by what MMOwned has become, I'll start being honest now.
Whats said above is mostly just what people think, Errage, that you are an emulator section moderator doesn't make you know everything. (Not ment insultive, but remember that, Moderators are to keep the forum clean, Emulation experts are who actully knows about emulators. Now this makes it seem like I'm saying myself is smart... But well, you get the point.)
Blizzard uses a spyware program called "Warden". Its the "best" spyware there is, because its 100% legal.
If Blizzard wanted, they'd ban everyone having emulators on in the background. Takes them 1 hour of programming, MAX, and then, Warden will be programed to look for the emulators.
Then, You'd be banned under 20 seconds.
So, thought they do not ban you for it now, I would recommend you to NOT do it, Blizzard may update warden at ANY time.
There are some programs to stop Warden tho, not sure at how effective it is...
Also, from what I've heard, or, really what an GM "accidently" said, they only got the chat logs for 2 weeks.
FOR A MOMENT, NOTHING HAPPENED. THEN, AFTER A SECOND OR SO, NOTHING CONTINUED TO HAPPEN.
