Private Servers, Are just anouther way of using World of Warcraft, Unless you make someone Pay by Donating or to P2P (Pay to Play) for your server, You aren't doing any harm to Blizzard's Creation here, Technically its not Illegal to create Private Servers, Unless they've suddenly changed the Terms and Conditions overtime and put that in, List time I read it, Everything was fine.

Pretty obvious that they're talking about private servers.

I disagree, private servers are clearly against the Terms of Use and EULA. You accept both of those when you start WoW for the first time. That in and of itself doesn't necessarily make them illegal, but it does mean that Blizzard has said that they will stop servicing you. However, most of the time, that doesn't happen. But according to the Theft Act 1978 (U.K.), "A person who by any deception dishonestly obtains services from another shall be guilty of an offence". And so on, and so forth depending on your location. So, quite frankly, it's up to a judge/jury/govt. to decide whether or not it's illegal..
