Edit: Except when using software breakpoints on scanned addresses.

Not banned (around 1 year) for read only CE. I think blizz know about this, but no violations of the agreement (not modify, not change client-code, not helping in game).

My patcher has been public for over 4 years and it uses debug registers. So I don't think they ban for debugging and I don't see them detecting it anytime soon, well until it becomes a more popular way of hooking.

But DR hook is really slow considering any exception handling. Best way to do is ASM JIT the critical code section where you want to "patch", which is also what I am doing.
