" We have no obligation or responsibility to, and will not reimburse or refund, you for any Trading Items, Virtual Money, or Virtual Goods lost due to such cancellation, suspension, or termination. You acknowledge that Niantic is not required to provide a refund for any reason, and that you will not receive money or other compensation for unused Virtual Money and Virtual Goods when your Account is closed, whether such closure was voluntary or involuntary. "

Welp, It can't hurt, and someone told me they did a refund through apple with no problems. Just do it anyway it can't hurt.

What about class action lawsuit or a petition, signed up by all who accualy spend monay over 50$ on the game and now it is simply "stolen" from 'em?

Unfortunately that is exactly what signing a TOS is for. I can see how that can be frustrating. Even without a TOS signature, a simple investigation by Niantic would show how your money was allegedly "stolen" and seeing infact your account was flagged for botting or whatever else, that lawsuit wouldn't be as easy as a win as you'd think. In the end, companies put EVERYTHING in the fine print to protect themselves from having to dish back the money people spent on their games, no matter what.
EDIT: But I would 100% try to get a refund by either A.) Going through your bank for a charge back, or B.) Appealing to Niantic themselves, and make up some story "got hacked". "Relatives logged in my account to see my pokemon overseas?" IDK I would try anything if the amount of money spent was substantial enough
