Not all bots are the same. Niantic might be using different detection methods. They may be letting those bots "live" to figure out how they work. Plenty of different reasons some get banned and some don't initially.

Two main factors:
1. Botter behavior plays a key part - to bot inhumanly or bot slow human-like..it could be anything in game, you name it!

2. Using out of date API to run the Bot

1. Only bot with the right api (as soon as a forced update is out, stop botting until bot devs get there api updated (or hashing keys))
2. Use a bot that / setup your bot to behaves as human as possible
3. Don't bot 4 to 6 or more hours a day (I bot 2 to max. 3 hours a day)
4. Use regulary different routes and walking speed
5. Bot as close as possible to your home (I never jump to another country)
6. Respect time distance (bot in city a, go to city b, respect the travell time)
7. I start my bot when i'm behind my comuter, i stop my bot when i leave, so i have always a view of what's going on (in case of a captcha, i can interact asap)

alot ppl stopped when 0.49 was forced and resumed botting with the release of the hashing server. some reached level 38

Bossland Hashing service supports til 0.51 API only. Latest they have paused the hashing service and PokeFarmer bot, until the Bossland dev or other devs to crack the new API, NO BOT is safe now
