A question - If someone were to make a Nox based mod. Something like a Nox based mod where the player would go in a certain direction almost on foot pace and return, would it still get flagged ?

Niantic is a small company, with maybe 70 employees. Pokemon accounts number in the tens of millions. If you are going to implement a ban, you will use a software algorithm to pick up hackers and cheaters. At this stage no one knows how or what is being flagged. If the bot or emulator you use generates a trace that can be tracked or flagged, then a ban is inevitable. If the bot/emulator does not leave a trail, then a ban is unlikely.
At the end of the day, the ban did very little except reduce number of accounts that uses the Niantic servers. Any pokemon in a gym can be taken down, regardless of level. So, a bot getting you to level 30 or 40 will give you higher level pokemons. You can knock someone else's gym down and install your pokemon there, only to be knocked down by another bot/player. So, what's the real harm? If you are low level, you can snipe gyms and this will get you the same amount of pokecoins that a high level player will get in any 18 hour period, given that you cannot hold a gym. This may be why we have not had a ban wave for over a month now. Once their server loads gets high, then they clean house and clear out the cheats.
The thing is, these higher level accounts could very well earn Niantic money, once it is played manually. Makes little sense to kill them then.
