Help getting back an old stolen account in WoW

A long time ago (around 2 years I think since it was the end of the Cataclysm expansion) I tried to sell my WoW account to a guy and he scammed me, I gave him everything and he didn't provide any payment. I have tried to get my account back by 'legal'/blizzard means but they always keep asking for an ID but the account isn't on my own name registered, it's on another name so I can't give them any ID and they keep saying that all the info should be filled in truthfully and that account sharing isn't allowed etc... Also I can provide the following additional info for my account if someone is up for helping me out: old e-mail of the account, character names and servers they are/were on, codes of the games that I have bought and put on this account(vanilla, burning crusade, wotlk, cataclysm), name of the account(i don't know the battletag sadly), secret answer and also codes for the gametime cards I have used. So I'm asking is it possible to get my account back? Of course I will provide payment for this service. Please contact me by PM if someone is interested.

You cannot take back old accounts that doesnt have atleast the same lastname from an identification, doesnt matter if you have all the cd keys all old mails or anything nowdays. You need an ID with the same name as the lastname on the account originally, and If the account is from erlier that battle-net was created it has to be in that lastname.

Okey, I know the first and last name of that account. If I made a new account with the same name as the original account would it work theoretically?
