I am tempted to buy some diablo 3 gold with the card. Can i get in a lot of trouble for this or what?

BUY SOME freaking gold right now and give it to me , then i give it to you back, with a porcent for me ..! best thing you can do, they cannot track the gold that way..>!!!
If he charges back, you might get in trouble with Blizzard (it is possible to charge back through your bank, if you talk to them personally, and convince them that it wasn't you buying the goods).
Worst case scenario, you could get banned from D3.

If a CC is saved you will still be asked to enter the security code (3 digits) on the back of the card which you don't have access to I assume so I will probably not work. Also if the card has Verify by Visa enabled or Mastercard equivalent then thats another roadblock. Also, As other guy mentioned above me the CC will most probably get charged back and you'll get in trouble.
Is the credit card account holder from the same country ?

This is a dumb question. There is no good outcome. You also don't have the *** # and can't. Getting banned in Diablo 3 is NOT the worst case scenario. rofl.
Theft? Identity theft? ****ing over Blizzard and having to deal with them when the action is disputed?

Except that in theory, the CC is assigned to the original owner's account, and since account selling is against ToS, that account still "belongs" to him, according to Blizzard and his CC.
Which means, that if he could actually buy anything with that CC, it would be seen as the CC holder using his CC on his account. He holder could then claim the account was hijacked, and get a chargeback through his bank. This would result in Blizzard having their money revoked, which would cause an account ban.
You can't say "identity theft", because in theory, it's still the original owner's account.
maybe not "identity theft" in law - but at least its something you should not do
so just keep away from that and make your money with botting - what does NO HARM to anybody (even blizzards get their share)
to have the posibility to do something does not gives you the right just "because you can" - think about why you just dont rob your neightbours if you could use some money for booze ?
