thats not what i asked.

Say in patch 2.0.3 its undetectable and its all good, however, in patch 2.0.4 they release something which does detect it. What i asked is, 'is this bannable'...so IF in a future patch they DO detect it, can i get banned for it?

no shouldn't ever be bannable, this version or the next very basic, only thing that you may get banned for is where you get by using it..
