I think if you merge it with one of your own battle.net account you might be able to. Because then the account name would change, i am not too sure i am kind of in the same situation as you, i'll let you know how i do aswell

all the person has to do is call blizzard and its so easy to reverse. your best bet is to transfer to new account and ban the old one

There no 100% way to own an account unless you created it yourself ( with your name registered)
Any stolen account could be taken back any time.
The only 100% way to own an account (even if your the original creator) is to be blizzard. Blizzard owns every single persons account. It is in the ToS or EULA... i 4get which.
from what ive been reading, i think the best chances to "perm" control the account is to:
1. Create new wow account. Use the exact same name created to use the 1 you scammed.
2. Transfer the character to your new account, make sure u have the email changed to yours
Before you do so! Its to avoid him seeing the char transfer!
3. Get old account perm banned. Use detectable bot or whatever method u preffer.
4. Call blizzard and say u got married and want a last name change!
5. Merge blizzard to battlenet account thats on your name
6. Pay attention to the old account, and perhaps call blizzard to delete the
Account! U need all info for it tho. Including ID

MrYeah's idea would possibly work. It's not 100% guarantee, but it can work.
Your taking a risk, your either going to lose your account, or you will keep his characters.
Another way I read about is merging your main account and the scammed account to a bnet. Transfer the characters from scammed to main. Ban the scammed account. I don't know if this method work but it seems like it could.

Nothing you do will guarantee that you'll keep the account. I wouldn't dare transfer a character over too my main Bnet account.
- Make a new battle.net account with the same first name. Change the last name to something else.
- Merge the account to the battle.net account.
- You have control of the account, the person cannot log in. However, they can still recover it.
- Make a new account with the original first/last name.
- Transfer the characters.
- Call Blizzard, say that you got divorced (or married, divorced is less suspicious) and your credit card has your maiden name on it, and want to change the account names to avoid billing discrepancies. They should agree (anything to avoid discrepancies in potential profit), and voila. It should be yours.
- Change as much info as you can. Character name, server, faction, etc. Just creates more red tape for programmers to search through. They don't solve every case. They really just don't care that much, or it gets dumped into a huge database of Cold Cases, and you have your account!
seems too me to risky to merge it with your main bnet account. You risk getting your main account banned as well.
If you can somehow transfer the stolen characters to a new account and keep them for 2 months, then they are yours. Blizz won't reverse character transfers after 2 months.
